Joint Hearing Proceedings
September 7, 2021
Call To Order: Mayor, Carla Schepler, called the public joint hearing of the Planning & Zoning Committee and the Edgemont Common Council to order at 6:30 p.m. on September 7, 2021, at Edgemont City Hall. Present were Council members, Bill Bethel, Roger Horton, Cindy Millburn, Lorie Wieser and Jason Shook. Bob Worden was absent. (Roger Horton) and Bob Shannon were present for the Planning & Zoning Committee.
ORDINANCE 2021-9-7-1 – AN ORDINANCE ENTITLED, AND ORDINANCE TO AMEND SECTION 2.08.01, “PERMITTED USES” [HC-HIGHWAY COMMERCIAL DISTRICT]; ARICLE IV, “SUPPLEMENTAL REGULATIONS; AND ARTICLE V, DEFINITIONS, ADOPTED BY ORDINANCE 2021-9-7-1, AS AMENDED, OF THE ZONING ORDINANCE OF THE CITY OF EDGEMONT.
Open Public Hearing: Mayor Schepler declared the open of the public hearing.
Public Comment: Carolyn Duemig asked why this is coming to Edgemont?
Mayor Schepler responded by stating that it is going to be everywhere and something needed to be in place. If we don’t do something then anyone can come in and grow it anywhere. This will give us control.
Jarrell Rola asked about the restrictions for where the dispensaries can be located.
Mayor Schepler said that the committee was still working that out but talking about not near schools, bars, etc. There will be time restrictions also. But mostly downtown.
Gail Bethel asked about a map that showed the zoning.
Mayor Schepler stated that there was one up front on the counter.
Jarrell Rola stated his concerns about it being on the street where he lives with his daughter. It is very easy to get and is concerned.
Mayor Schepler stated that he should go to the zoning committee and voice his concerns.
Discussion concerning 3rd Avenue being an alternate route was heard.
More discussion was had concerning downtown area placement of dispensaries.
Cad Waite asked how far from a bar it needed to be?
Mayor Schepler said she thinks it was 250 feet.
Bob Shannon stated some of the rules and regulations within the ordinances and State laws.
Roger Horton stated that the County does not have Edgemont’s zoning.
Bob Shannon continued the discussion on zoning.
Lorie Wieser stated that this was just the first reading and the public hearing is for the citizens to voice their concerns and to give the council the chance to work things out to make a good decision.
Jason Shook stated that as far as a lot of people were concerned 2nd Avenue would always be zoned as commercial because that is the Main Street where the businesses are located.
Bill Bethel said that there were also the “100” blocks that could also have a dispensary and some of those         properties were zoned residential. There are also other licenses, first the dispensary license and then there are the cultivation, manufacturing and testing licenses. We can regulate not only zone type but locations.
Carolyn Duemig said,” I don’t want to be obnoxious but I want to have a heroin dispensary!”
Lorie Wieser said to take it to the State and get the vote.
Bill Bethel said that whether it’s right or wrong is irrelevant, what we have to do is to pass these things to keep people from running amok. We have to do something, we just can’t say nothing.
Jason Shook stated that we can always state if it has to be commercial/residential at a later date. We just need to get the basics done now.
Bob Shannon had many topics that he discussed.
Lisa Pawlowski and Carolyn Duemig asked questions concerning licensing and number of licenses the City would have.
Mayor Schepler thanked everyone for their input and said that they would take all of the suggestions into consideration.
Close of Public Hearing: After asking for any further comments Mayor Schepler closed the public hearing.
Planning & Zoning Approval Of Ordinance 2021-9-7-1 – First Reading: Lorie Wieser made a motion to approve Ordinance 2021-9-7-1 as read. Motion was seconded by Cindy Millburn. Motion carried with unanimous roll call vote.
Adjournment: Jason made a motion to adjourn at 7:10 p.m. Motion was seconded by Lorie Wieser. Motion carried with unanimous vote.
