Fall River County Unapproved Minutes of August 5, 2021
The Fall River Board of County Commissioners met in regular session on August 5, 2021. Present: Joe Allen, Les Cope, Joe Falkenburg, Heath Greenough, Deb Russell and Sue Ganje, Auditor.
The Pledge of Allegiance was given, and the meeting called to order at 9:00 a.m.
The agenda was reviewed for conflicts; none were noted. All motions recorded in these minutes were passed by unanimous vote, unless otherwise stated. Motion made by Cope, seconded by Russell, to approve the agenda as written.
Motion made by Russell, seconded by Allen, to approve the minutes for July 15, 2021.
Motion made by Cope, seconded by Allen, to surplus to junk HP 505B CPU, #01669; HP 505B, #01665, and HP 8200 PC, #01928, all from the Sheriff’s Office, and TP-Link Wireless Router Dualband, #02061, Veteran’s Service Officer.
Motion made by Russell, seconded by Cope, to set a hearing for an Off-Sale Liquor License for Forney’s Standard Service, August 19, 2021 at 9:30 a.m.
Motion made by Greenough, seconded by Russell, to set a hearing for the distribution of the 2022 PILT monies, August 19, 2021 at 9:35 a.m.
Motion made by Russell, seconded by Allen, to approve travel, with per diem, for Dan Cullen, Veteran Service Officer, to attend the SDDVA Annual workshop and training, Ramkota Inn, Pierre, August 16 through August 18, 2021.
Motion made by Russell, seconded by Allen, to approve travel for Sue Ganje (Auditor), Melody Engebretson (Register of Deeds), Teresa Pullen (Treasurer), Randy Seiler (Highway Superintendent) and all Commissioners that are interested to attend the 2021 County Convention, September 13 and September 14, 2021, Rapid City.
The board reviewed emails from parties regarding railroad transportation and survey studies for the railroad. The board will invite Brett Sebastian to a future meeting to discuss rail/transportation polices.
Motion made by Cope, seconded by Greenough, to approve the following resolution:
Resolution #2021-37
Whereas, the Fall River County Board of Commissioners have designated August 5th through August 12th, 2021, as a week to honor Eric Shull, former Highway Department employee, who passed away on July 25th, 2021. The Commission requests that in his honor, the American flag at the courthouse be lowered to half-staff; and
Whereas, Eric Shull began his employment with Fall River County on July 8th, 2019 as a truck driver, hauling gravel to all locations in the County. He took personnel initiative when needed, at one time purchasing and installing parts on his own time, he was diligent to ensure that the safety of the County was a priority. His call sign, 27C18, has now been retired;
Whereas, the Fall River County Board of Commissioners give thanks to the service Shull rendered unto Fall River County; and
Now, therefore, be it resolved that the Fall River Board of County Commissioners calls upon all citizens of Fall River County to observe the week of August 5th through August 12th, 2021, in recognition of the service of Eric Shull, who by his devotion to duties, had rendered invaluable service to the County, and we further call upon the citizens of Fall River County to pay respect and offer their deepest sympathy to the family and friends of Eric.

Fall River County
Frank Maynard, Emergency Management, met with the board to state that his request for part-time position will be on the next agenda, and that he has completed all the required paperwork for the 3rd quarter per the L.E.M.P.G. Agreement. Maynard is working to complete the applications for the Safety Benefits annual awards and advised that he participated in the required Emergency Operations Center Exercise on July 21st. A ceremony will be held August 11, 2021, the 10th anniversary of the Coal Canyon Fire, noted the fire potential for Southwestern South Dakota and reported on fires and incidents.
Discussion was held on the county and the extreme drought situation. Maynard will check with the FSA and see what action has been taken.
Stacey Martin, GIS, met with the board. Motion made by Greenough, seconded by Allen, to approve the Newman Sign quote, for 911 signs, in the amount of $2,246.71.
Motion made by Greenough, seconded by Russell, to approve hiring temporary part-time help, Jonathan Lovett, $14.05 per hour, for 40 hours or less.
Les Cope, Commissioner, met with the board. Motion made by Greenough, seconded by Allen, to appoint Cope, Tom White and Jerry Stearns to the Ag Task Force.
Cope also spoke about the Fall River County 30 X 30 resolution not being posted on the American Stewards website. This will be checked into further.
Susie Hayes, Director of Equalization, met with the board. Motion made by Greenough, seconded by Russell, to approve the following revised resolution:
Fall River County Resolution No. 2020 – 24 Revised
Discretionary Formula SDCL 10-6-137
WHEREAS, the County of Fall River, State of South Dakota has deemed it in the best interest of the County to adopt a Resolution implementing a Discretionary Formula for the reduced taxation of new structures and additions and partially constructed structures pursuant to SDCL 10-6-137.
NOW, THEREFORE, BE IT RESOLVED, that the following properties shall be, and hereby are, specifically classified for the purpose of taxation pursuant to SDCL § 10-6-137:
_X_ Any new industrial or commercial structure, or any addition, renovation, or reconstruction to an existing structure, located within a designated urban renewal area as defined in SDCL § 11-8-4, if the new structure, addition, renovation, or reconstruction has a full and true value of thirty thousand dollars or more (SDCL § 10-6-137(1));
_X_ Any new nonresidential agricultural structure, or any addition to an existing structure, if the new structure or addition has a full and true value of ten thousand dollars or more (SDCL § 10-6-137(3));
_X_ Any new commercial residential structure, or addition to an existing structure, containing four or more units, if the new structure or addition has a full and true value of thirty thousand dollars or more (SDCL § 10-6-137(5));
FURTHER RESOLVED, that any structure classified pursuant to this Resolution shall, following construction, initially be valued for taxation purposes in the usual manner, and that value shall be referred to in this Resolution as the “Pre-Adjustment Value”; and be it
FURTHER RESOLVED, that the assessed value to be used for tax purposes of any structure classified pursuant to this Resolution shall, following construction, be calculated as follows:
a. For the first tax year following construction, 20% of the Pre-Adjustment Value;
b. For the second tax year the following construction, 40% of the Pre-Adjustment Value;
c. For the third tax year following construction, 60% of the Pre-Adjustment Value;
d.
e. For the fourth tax year following construction, 80% of the Pre-Adjustment Value;
f. For the fifth tax year following construction, 100% of the Pre-Adjustment Value;
and be it
FURTHER RESOLVED, that the Board of County Commissioners may, if requested by the owner of any of the above described property, not apply the above formula, in which case the full assessment shall be made without application of the formula. In waiving this formula for the structure of one owner, the Board of County Commissioners is not prohibited from applying the formula for subsequent new structures by that owner; and be it
FURTHER RESOLVED, that for purpose of this Resolution, the assessed valuation during any of the five years may not be less than the assessed valuation of the property year preceding the first year of the tax years following construction; and be it
FURTHER RESOLVED, that any structure that is partially constructed on the assessment date may be valued for tax purposes pursuant to this Resolution and the valuation may not be less than the assessed valuation of the property in the year preceding the beginning of construction; and be it
FUTHER RESOLVED, that following the five-year period under this section, the property shall be assessed at the same percentage as is all other property for tax purposes.

Motion made by Greenough, seconded by Allen, to approve seeking and hiring one full-time administrative assistant and two full time administrative assistants (un-certified appraisers).
Motion made by Russell, seconded by Allen, to approve a computer purchase for the Director of Equalization.
Hayes updated the board that she ran a non-ag update article in the paper. Legislative changes are still needed. Hayes advised that as purchases have been over the market value on homes, she will work with the SD Department of Revenue to see if certain sales could be rejected. Allen suggested a letter to our District 30 Senator and Representatives.
Discussion was also held on soil adjustments and ag status applications; 30 – 40% more applications are still needed from agriculture individuals. The Department of Revenue and Dr. Elliott are still working on the Ag soil tables; they will not be applied for the pay ’22 tax year. State’s Attorney Russell will compose a letter to the Governor, along with a resolution concerning the soil table.
Teresa Pullen, Treasurer, met with the board. Motion made by Cope, seconded by Greenough, to approve two new accounts at First National Bank in Lead for monies from the American Rescue Plan and the Rural Access Infrastructure monies.
Carla Schepler, Mayor of the City of Edgemont, met with the board to request a resolution for the tax deed properties that the county is deeding to the City. Motion made by Allen, seconded by Greenough, to table the resolution until the next meeting.
The board requested that Schepler speak with Prairie Hills Transit about a grant for Edgemont.
Dusty Pence and Cheryl Fair met with the board to review the Public Participation at Commissioner Meetings policy for changes with the board. Motion made by Greenough, seconded by Allen, to table the Public Participation at Commissioner Meetings policy until the next meeting.

Break was taken at 9:50 a.m. and the meeting reconvened at 9:58 a.m.
Public comment was heard from Sheriff Evans, noting 15 males and 2 females in the Fall River County Jail, with 1 male in the Pennington County Jail, for a total of 18 inmates. Evans thanked the Commissioners for their approval to purchase the tasers. Additional comments were heard from Jeannine Lecy, Rick Collignon and Cheryl Fair thanking the Commissioners and the Highway Department for the extra efforts on Shep’s Canyon Road.
Randy Seiler, Highway Superintendent, met with the board. Motion made by Allen, seconded by Russell, to approve hiring Arthur Knodel, seasonal mower, $14.05 per hour, effective August 9, 2021.
Motion made by Russell, seconded by Allen, to approve Agreement #2021-27-1 between the SD Game Fish and Parks, Fall River County Board of County Commissioners for Shep’s Canyon Road. Motion passes by roll call vote.
Motion made by Allen, seconded by Russell, to approve the Agreement between the SD Department of Agriculture and Natural Resources and Fall River County for the SD Volkswagen Program Rebate. Motion passes by roll call vote.
Motion made by Russell, seconded by Allen, to approve advertising for sealed bids for a 2023 Freightliner 114SD Tractor (SD VW Rebate program) to be opened at the September 2, 2021 meeting.
Motion made by Greenough, seconded by Cope, to approve an application for a road approach permit on the north side of Erskin Rd., Co #17, approximately at 43.437112 103.587299° N to serve a business.
Seiler updated the board that they have been working on Shep’s Canyon Road for the last week; there is around 3,000 ton of gravel left that they are going to use for low spots shaping. The Highway Department will start mowing soon. Discussion was held on fire danger and the east end of Old Highway 79 being rough.
Lance Russell, State’s Attorney, met with the board to discuss the timeline and amendments that will need to be made to the original cannabis ordinance. The board will need to determine the number of cannabis dispensary establishments, the fee (SDACC recommends the same fee the state has at $5,000), the hours of operation and the setback/separation distances from specific uses. This will be brought back and discussed at the next meeting.
The board reviewed an Application for Isolated Tract Easement as submitted by the Bangs McCullen Law Firm, on behalf of Debra Irene Alexiou – Fleming and Harry Fleming. The board asked the Highway Department to review the section line area of the property. Motion made by Allen, seconded by Cope, to table the site visit until the August 19, 2021 meeting, to get a report from Highway Superintendent Seiler.
Discussion was held on wind energy on United States Forest Service lands, with Richard Mueller, Executive Vice President, GRID Logistics, Inc. present via phone. Chairman Falkenburg asked for a motion to support this; no motion was offered.
Motion made by Allen, seconded by Greenough, to not support wind energy on United States Forest Service lands.
Dustin Ross, Andersen Engineers, met with the board. Motion made by Allen, seconded by Cope, to approve the following resolution:

Fall River County Resolution #2021-42
A Plat of Lot 20A revised and Lot 20B revised of Clearwater Lake Estates, located in the NE1/4 of Section 16, T8S, R6E, BHM, Fall River County, South Dakota
Formerly Lot 20A and Lot 20B
WHEREAS, there has been presented to the County Commissioners of Fall River County, South Dakota, the within plat of the above described lands, and it appearing to this Board that the system of streets conforms to the system of streets of existing plats and section lines of the county; adequate provision is made for access to adjacent unplatted lands by public dedication or section line when physically accessible; all provisions of the county subdivision regulations have been complied with; all taxes and special assessments upon the property have been fully paid; and the plat and survey have been lawfully executed; now and therefore,

Sue Ganje, Auditor, met with the board to discuss a change in software and the estimated costs over a 4-year period of $337,000.00.
Break was taken at 10:55 a.m. and meeting resumed at 11:10 a.m.
The board and auditor discussed the 2022 Provisional budget, including the ‘22 budget requests, tax levies, revenues and cash that will be applied, and will be submitted to the paper for publication prior to the September 2, 2021 meeting.
Motion made by Cope, seconded by Russell, to enter executive session, as per SDCL 1-25-2(1) for personnel purposes and as per SDCL 1-25-2 (4) for negotiations at 11:26 a.m.
The Board came out of executive session at 11:46 a.m.
Motion made by Russell, seconded by Greenough, to adjourn at 11:49 a.m.
